장애인 환자의 연명의료결정 시 자기결정권 존중과 의사결정 조력*

「호스피스ㆍ완화의료 및 임종과정에 있는 환자의 연명의료결정에 관한 법률」(이하 ‘연명의료결정법’ 이라 한다)이 2017년 8월 4일 시행을 앞두고 있다. 이 법은 오랜 시간 사회적 논의과정을 거쳐 제정되었지만, 장애인 환자의 연명의료결정 시 자기결정권을 존중하기 위한 논의는 충분하지 않았다. 이 글에서는 연명의료결정법의 시행 이전에 풀어나가야 할 과제로, 유엔 ‘장애인 권리협약(Convention on the Rights of Persons with Disabilities)’과「장애인차별금지 및 권리구제 등에 관한 법률」,「발달장애인 권리보장 및 지원에 관한 법률」에서 인정하고 있는 장애인의 자기결정권과 장애인 당사자의 권리, 의지및 선호도를 존중하는 ‘의사결정 조력(supported decision-making)’과 관련된 쟁점을 다루고 있다. 나아가 장애인 임종기 환자의 연명의료결정 시 자기결정권을 실질적으로 보장하기 위해 고려해야 할 의사결정 조력 방안들에 대해 논의하고자 한다.

The Hospice, Palliative Care, and Life-sustaining Treatment Decision-making Act (hereafter referred to as “Lifesustaining Treatment Decision-making Act”) will come into effect on August 4, 2017. While drafted after prolonged public debate, the Life-sustaining Treatment Decision-making Act still failed to sufficiently discuss how to respect the right to self-determination of people with disability, when making decisions relating to life-sustaining treatment. In an effort to improve this legislation, this paper articulates the viewpoints established in other legal documents, such as the Convention on the Rights of Persons with Disabilities and the Act of the Prohibition of Discrimination against Disabled Persons of United Nation (UN), relating to self-determination of people with disabilities. It further discusses the practical need for supported decision-making, for patients with disabilities considering life-sustaining treatment decisions.
