삶의 마지막에서 존엄성을 어떻게 고려할 것인가: 안락사와 의사조력자살의 논변 분석을 중심으로*

이 글은 존엄성 개념이 안락사와 조력자살을 ‘찬성’하거나 ‘반대’하는 도덕적 논증의 기초가 된다는문제성으로부터 출발하였다. 이는 생명윤리와 관련한 중요 이슈를 분석하는 데 있어 인간 존엄성에대한 호소가 최종적인 근거로서 받아들여져야 할 것이 아니라, 보다 정교한 분석이 필요한 출발점임을 보여주는 대표적 사례다. 그래서 이 글은 존엄성 개념을 명료화하여 이를 삶의 마지막에서의 의료적 돌봄에서 나오는 대표적 이슈, 즉 안락사와 의사조력자살에 적용해보는 것을 목적으로 삼았다. 적용 지점을 안락사와 의사조력자살에 맞춘 이유는 첨단 과학기술의 경연장이 되고 있는 기술의학의 시대에 존엄성에 대한 정교한 접근은 매우 필요하기 때문이다. 그래서 본 글은 의료윤리학자 Sulmasy의 논의를 토대로 존엄성 개념을 내재적 존엄성과 속성적 존엄성으로 구별하고 양자 간의 유기적 연관관계를 확보함으로써, 속성적 존엄성을 기초로 한 안락사와 조력자살 찬성논변의 한계를 비판적으로 검토하였다.

The concept of dignity receives much attention in biomedical ethics, especially with respect to care at the end of life. Paradoxically, the concept is used in moral arguments both for and against euthanasia and physician-assisted suicide. This article aims to shed light on the contemporary concept of dignity. More specifically, this article attempts to define the concept and show its relevance to arguments for the legitimacy of euthanasia and physician-assisted suicide. Additionally this article offers guidelines for the appropriate role of dignity considerations in debates concerning end-of-life care.
